This article examines the case of the controlled confinement of toxic waste in Guadalcázar, San Luis Potosí, in light of the intergovernmental relations approach. It aims to explore the implications that the distribution of legal responsibilities in environmental matters, as well as human settlements between the three orders of government had on the initiative for establishing a toxic waste dump. Within the framework of this approach, the legal analysis is complemented by a review of factors that are not exclusively legal, which, by influencing the attitude of the government personnel involved, affected the result of the case.
En este artículo se examina el caso del confinamiento controlado de desechos peligrosos de Guadalcázar, San Luis Potosí, a la luz del enfoque de las relaciones intergubernamentales. El objetivo del trabajo es explorar las implicaciones que la distribución de competencias legales en material ambiental, así como los asentamiento humanos entre los tres órdenes de gobierno, tuvieron en el resultado de la iniciativa para establecer el basurero tóxico. En el marco de este enfoque, se adiciona al análisis jurídico una revisión de factores no exclusivamente legales que, al influir en la actitud del personal gubernamental implicado, afectaron el resultado del caso. |
