By invariably attributing a social responsibility to the press, the ruling class sought to promote, organize and control or “civilize” this new means of communication in development, which was a sort of prelude to the media era, despite being aimed at only a small part of the population. The functions of the ideal newspaper were many: it was considered essential to aid in the task of building the nation and giving legitimacy to the new, still-fragile state, as well as to serve as a tool in the construction of political society and the propagation of new, “enlightened” norms. Taken together, this created inevitable tensions and contradictions between ideology and pragmatism, between constitutional principles and applied law, as well as discordances in the desire to neutralize the partisan struggles in which politicians participated. These contortions reveal the period’s experimental character, determining the close relationship between the government and the press, as well as laying the basis for journalistic culture. This study offers a precise chronology of general press regulations and a periodization of a variety of circumstantial legal provisions. This chronology is compared with one of journalistic production, which, when repressed, is always reborn from the ashes.

Con base en los informes ministeriales presentados ante el Congreso, el estudio, sin caer en el esencialismo en torno a la “censura”, busca descifrar las dinámicas políticas y las condiciones jurídicas en las que se establecen las distintas reglamentaciones de libertad de imprenta durante la primera etapa nacional del México independiente. Al atribuir invariablemente una responsabilidad social a la prensa periódica, la clase gobernante pretende a la vez fomentar, organizar y controlar o “civilizar” este nuevo medio de comunicación en pleno desarrollo, suerte de preámbulo a la era mediática pero todavía dirigido a una parte reducida de la población. Las funciones del periódico ideal son entonces múltiples: considerado indisociable auxiliar de la construcción nacional y de la legitimidad del inédito y frágil Estado, es también herramienta de la edificación de la sociedad política y de la propagación de nuevas normas “ilustradas”. El conjunto genera tensiones y contradicciones inevitables entre la ideología y el pragmatismo, entre los principios constitucionales y el derecho aplicable, así como discordancias en el deseo de neutralizar las luchas partidistas en las que participan los propios gobernantes. Las tergiversaciones revelan el carácter experimental del periodo, que determina las relaciones entre poder y prensa, verdadero binomio, y a la vez sienta las bases de cierta cultura periodística. El estudio ofrece una precisa cronología de las vigencias de las normatividades generales, así como una periodización de las numerosas disposiciones legales circunstanciales, cronología comparada con la producción periodística, que, si bien es reprimida, siempre renace de sus cenizas.
