By studying the prevailing political, economic, and social context in the state, the author shows how liberal governors --repeatedly-- pronounced themselves in favor off dissolving and privatizing this type of property. However, governors were oblivious to the general conditions that favored the initiative, and --paradoxically-- promoted actions opposed to the reform. The most compelling evidence was that the Political Constitution of the State of Oaxaca (1857) --directly opposed to the Lerdo Act (1856) and the Federal Constitution (1857)-- allowed municipal governments and agencies to continue owning and managing properties under an old-regime corporate model. |

Este artículo revela la postura que asumió el gobierno de Oaxaca frente a la reforma que pretendía disolver los bienes comunales de las corporaciones civiles entre 1856 y 1857. A través de estudiar el contexto –político, económico y social- que prevalecía en la entidad se pone en evidencia que los gobernantes liberales se pronunciaron -repetidamente- a favor de disolver y privatizar este tipo de bienes. Lo relevante del caso es que, al tiempo de presentarse las condiciones para codificar la iniciativa, los gobernantes se mostraron ajenos a dicha perspectiva y –paradójicamente- promovieron acciones contrapuestas a la reforma. La prueba más evidente fue que la Constitución Política del Estado de Oaxaca (1857) -en franca oposición a la Ley Lerdo (1856) y la Constitución Federal (1857)- facultó a los ayuntamientos y agencias municipales para que continuaran poseyendo y administrando bienes bajo un esquema corporativo de antiguo régimen.
