| description | This article analyzes how the freedom of the press was understood in Mexico just before the midpoint of the 19th Century, as well as the elements that shaped its exercise. In the autumn of 1840, a pamphlet was published in Mexico City that proposed monarchical government as a solution to the country’s problems. The rejection of the pamphlet’s proposal was unanimous and the author and publisher were put on trial for its subversive content. The outcry that followed led to a discussion on the importance of the press for Mexico and accusations that the government had threatened its freedom by arresting them. Primarily based on the contemporary press and legal decrees, this article analyzes the reactions to the publication of this pamphlet and its consequences, showing the role of the press in the world of politics, the strategies used by the government to regulate it, the way in which the relevant laws were interpreted and applied and the reciprocal relationship between the activities of the press and the political panorama. This article contributes to the interpretation of the press (pamphlets, printers, writers) as an actor, sometimes a leading one, in the politics of 19th Century Mexico and the freedom of the press as a right that had to be closely regulated. |

El artículo tiene como objetivo analizar cómo era entendida la libertad de prensa poco antes de mediar el siglo XIX mexicano, así como los elementos que daban forma a su ejercicio. En el otoño de 1840 fue publicado un folleto en la capital que proponía considerar la monarquía como forma de gobierno para superar los problemas del país. El rechazo fue generalizado y dio inicio un proceso judicial en contra del autor y el impresor del texto por considerar su contenido subversivo. El alboroto ocasionado dio lugar a que se discutiera la importancia de las imprentas en la vida del país y se acusara al gobierno de atentar en contra de la libertad de prensa por haber apresado al impresor del folleto. Con base principalmente en fuentes hemerográficas y decretos legales, se analizan las reacciones y consecuencias que tuvo la publicación para mostrar la participación de la prensa en el terreno de la política, las estrategias utilizadas por parte del gobierno para regularla, la manera en que se echaba mano de las leyes correspondientes, se interpretaban y aplicaban, y la recíproca incidencia que existía entre las actividades de las imprentas y el panorama político. El trabajo aporta elementos que dan fuerza la interpretación de considerar a la prensa (impresos, impresores, escritores) como un actor más, en ocasiones protagonista, de la política en el México decimonónico y a la libertad de prensa como un derecho que debía ser estrechamente regulado.
