| description | This article places the book Discurso sobre las penas, by the celebrated jurist Manuel de Lardizábal y Uribe, in dialogue with other books of its epoch -primarily the work of Beccaria, but also other prominent intellectuals and jurists who then spoke in favor of leniency and prison reform. The author reexamines Lardizábal's work in the European context, particulary that of a Spain that vaccilated between reform and a return to tradition, thus suggesting that Lardizábal y Uribe has made a larger contribution to liberal thought than has previously been conceded by many historiographers. This articel reconstructs the debate that ocurred between different spaces, both European and American, regarding issues of criminal justice and the humanization of punishment. |

This articel reconstructs the debate that ocurred between different spaces, both European and American, regarding issues of criminal justice and the humanization of punishment. El artículo pone en diálogo el libro del célebre penalista Manuel de Lardizábal y Uribe, el Discurso sobre las penas, con otros libros de su época. Fundamentalmente con la obra de Beccaria, pero también con la de otros intelectuales y juristas destacados que entonces hablaron en favor de la moderación de las penas y de las mejoras de la vida carcelaria. Le preocupa revalorar la obra de Lardizábal en el contexto europeo y en el de una España que se debatía entre el reformismo y los atavismos de la tradición, y plantea que existe mayor relación entre su aporte y el pensamiento liberal de lo que una parte de la historiografía le ha concedido. Ofrece evidencias sobre el debate que se produjo entre distintos espacios, europeos y americanos, en torno a los temas de la justicia y la humanización de los castigos.
