description | One of the most widespread interpretations of Agustín de lturbide's consummation of the Mexican lndependence considers the political program of the Plan de Iguala and the Tratados de Córdoba as an anticonstitutional movement, opposed to the legal-political modernity prevailing in the early nineteenth century. This article seeks to discard definitively this interpretation, demonstrating that although Iturbide's political program was contrary to the Constitution of Cádiz, this was not because it was a constitution, but because it ignored the Mexican reality, always defending the need to establish a modern constitutional order for the emerging Mexican Empire, but with an advantage over the one from Cádiz, in that it was an order ad hoc to the circumstances, needs and history of that Empire, formerly New Spain. If Iturbide's program opposed the 1812 Spanish Constitution, it was because it privileged the historical constitution over the one accepted in Cádiz for all the Spanish Empire, not specifically for México. The author analyzes several of Iturbide's documents where this program was expressed without contradictions from 1821 to the moment of his death in 1824. |

Una de las interpretaciones más difundidas en torno a la consumación de la independencia de México llevada a cabo por Agustín de Iturbide, consiste en ver el programa político plasmado en el Plan de Iguala y los Tratados de Córdoba como un movimiento anticonstitucional y, por ende, reaccionario a la modernidad jurídico-política imperante a comienzos del siglo XIX. El artículo pretende desechar de una forma definitiva esta interpretación demostrando que si bien el programa político de Iturbide fue contrario a la Constitución de Cádiz no lo fue por el hecho de ser una constitución, sino por no contemplar la realidad mexicana, defendiendo en todo momento la necesidad de establecer un orden constitucional moderno para el naciente imperio mexicano, con la ventaja sobre el gaditano de ser un orden ad hoc para las circunstancias, necesidades e historia de ese imperio, antaño la Nueva España. Si el programa de lturbide se separó de la Constitución española de 1812 fue porque dio preeminencia a la constitución histórica sobre la forma aproba da en Cádiz para todo el imperio español, no específicamente para México: el autor analiza diversos documentos de Iturbide donde quedó plasmado este programa sin ninguna contradicción desde 1821 hasta el momento de su muerte en 1824.
