| description | This work seeks to reveal the aim of those participating in the River Plate independence movement, and how they legitimated the establishment of local governments. The author explains how political legitimacy was based on the doctrine of “retro version of sovereignty to the people”, and on the principle of consent, core of the contractual conceptions typical of natural law, and how this sovereignty was assumed by the viceroyalty's “principal cities”, since there didn't exist then “a” people, but fourteen “American peoples”. He also explains how in its origins the “May Revolution” was not an independence movement, nor a result of a previous plan, but an audacious decision of the “American Spaniards” —supported by some peninsular Spaniards— to take control of the events produced by the monarchical crisis. |

El artículo se propone discernir el objetivo de los participantes en la gestación del movimiento de independencia rioplatense y la forma de legitimar la constitución de gobiernos locales. Expone cómo la legitimidad política se basaba en la doctrina de la “retroversión de la soberanía al pueblo” y en el principio de consentimiento, núcleo de las concepciones contractualistas propias del derecho natural. Y también cómo la soberanía fue asumida por las “ciudades principales” del Virreinato, dado que entonces no existía “un” pueblo sino catorce “pueblos americanos” soberanos. Explica también que la denominada “revolución de Mayo”, no fue al comienzo un movimiento de independencia, ni resultado de una elaboración previa, sino una audaz decisión de los “españoles americanos” —con apoyo de algunos peninsulares— para tomar el control de los acontecimientos derivados de la crisis de la monarquía.
