This context reveals the power of Indian cabildos (councils) over the town lands and over the transfer of lands among Indians or between Indians and Spanish, Criollo or Mestizo grupos, which were not controlled by the Tribunal. The evidence of this process of Mayan land privatization suggests that towards the mid-eghteenth centruy, the right to private property had gone beyond the small grupo of Mayan high classes. This evidence also reveals that the idea of Indians embracing an essentially communitarian notion of land characterized the regime, not the cabildos or the Indians in general. |

Con base en vestigios documentales de los últimos 70 años del dominio colonial en la península yucateca, este artículo presenta las circunstancias que caracterizaron la venta de tierras privadas mayas con la intervención del Tribunal de Indios, contexto en el que resulta manifiesto el poder de los cabildos indígenas sobre las tierras de los pueblos y también sobre el traspaso de tierras entre indígenas o de éstos a los grupos españoles, criollos y mestizos al margen de control del Tribunal. Se trata de un proceso de privatización de tierras mayas cuyas evidencias sugieren que hacia mediados del siglo XVIII, el derecho a la propiedad privada había rebasado el restringido círculo de los altos estratos mayas y, a la postre, arrojan que la idea del indígena apegado a una concepción eminentemente comunitaria de la tierra era una aspiración de los funcionarios del régimen colonial, pero no de los cabildos ni de los indígenas en general.
