This paper analyzes how this process began in Mexico and Argentina with the actions undertaken during the preliminary agreements of Ayutla (1854) and San Nicolas (1852) and the debate of constituent assemblies. These two case studies were chosen because, according to recent studies on the nineteenth- century political transition process, the same process of territorial fragmentation of control over coactive means had a very different evolution in the two countries, regarding the ability to consolidate the State's coactive power and to use it as an instrument to strengthen a new constitutional order. This work tries to understand the historical and cultural causes of the differences. |

Uno de los problemas históricos principales de la formación de los Estados modernos en América Latina, fue la consolidación de un poder coactivo bajo el estricto y exclusivo control de las autoridades constitucionales. Este artículo analiza los orígenes del proceso de configuración de dicho poder en los casos de México y de Argentina, a partir de las medidas que se adoptaron al respecto durante los acuerdos preliminares de Ayutla (1854) y de San Nicolás (1852) y del debate de las asambleas constituyentes. La elección de estos dos casos se debe al hecho de que, según los estudios más recientes acerca del proceso de transición política del siglo XIX, a partir de una situación similar de fragmentación territorial del control sobre los medios de coacción, los dos países parecen evolucionar de manera muy diferente en su capacidad de consolidar el poder coactivo del Estado y en su utilización como instrumento para consolidar un nuevo orden constitucional. Sobre la base de esta premisa, el objetivo del artículo es otorgar una posible interpretación de las causas históricas y culturales de esta diferencia.
