The shape it acquired through prac­tice received several names: public spirit, popular will and public opinion. These images worked  both as a mirror of society and as a legitimating device. The pamphlets printed in México during 1856-1861 reflect well the work carried out by the intellectual eli­tes of Constitutionalism -"societies of thought" (sociedades de pensamiento), according to Augustin Cochin- in order to ma­terialize an abstract republican ideology. The national "imaginary" contained in this kind of printed matter refers not only to discourse, but also to the issue of cross-points between history and fiction. The fact that Comonfort, after vowing before Congress, declared it impossible to rule with the 1857 Constitution, ocurred so because that law and its corresponding political rethoric -the "constitutional imaginary"- had imposed a barely-feasible democratic and representational model. This work gathers some issues of constitutional rethoric, in order to analyze, under a new light, the tensions between a formal constitution that legislates to obtain a strong Congress, and Mexico's historical constitution, that claimed gradual changes, considering the long tradition of democratic power renewed by Santa Ann's dictatorship.

El "imaginario", tal como se le pretende considerar en este trabajo, es una construcción simbólica enla memoria colectiva. Busca modelar la conciencia de identidad, y a partir de  ésta, organizar la sociedad. La forma que adquirió en la práctica se llamó de maneras muy diversas: espíritu público, voluntad popular o bien opinión pública. Estas imágenes funcionaban a la vez como espejo de la sociedad y como dispositivo legitimador. La folletería impresa en Mexico en el periodo 1856-1861 es un buen reflejo de la actividad que las élites intelectuales del constitucionalismo -"sociedades de pensamiento" según Augustin Cochin- llevaron a cabo para darle materialidad a una ideología republicana abstracta. El "imaginario'' nacional contenido en este tipo de impresos no remite únicamente al discurso; incorpora la problemática del entrecruzamiento de historia y ficción. Si Comonfort, después de haber ju­rado ante el Congreso, afirmó que con la Constitución de 1857 no se podía gobernar, era porque aquella ley y la retórica políti­ca que la acompañaban -el "imaginario constitucional"-habían impuesto un modelo democrático y representativo de difícil rea­lización. Aquí recogemos algunos tópicos de la retórica consti­tucionalista que nos permiten ver con luces nuevas las tensiones entre una constitución formal  que legisla para  obtener un con­greso fuerte, y la constitución histórica de México, que reclama­ba cambios  paulatinos teniendo en cuenta la larga  tradición de poder monocrático, renovada por la dictadura santanista.
