description Historians tend to turn to textual sources to configure a corpus of historical data, in accordance with their research methods and objectives. Although to a certain extent they understand that their sources have their own history, the study of the history of their properties and discursive forms has fallen, above all, on disciplines such as philology, literature, rhetoric, diplomacy, textual criticism, paleography and linguistics. This article reflects on the historicity of other cultural traditions, such as law, utilizing the theory of discursive traditions developed by the followers of the linguist Eugenio Coseriu and emphasizing how the historical rhythms of different cultural traditions may be asynchronous and that linguistic forms tend to be much more conservative than those of other cultural traditions. The textual traditions of Mexican legislation from the 16th to the 21st centuries are taken as an example, as well as their relationship with the legal traditions to which they gave rise. The article discusses how to historically interpret legal traditions and their relationship with textual traditions according to hermeneutics, conceptual history and Reinhart Koselleck’s sediments of time.

El historiador suele acudir a fuentes textuales para configurar un corpus de datos históricos, según sus objetivos y métodos de investigación y, aunque en cierta medida se tiene consciencia de que las fuentes tienen su propia historia, el estudio histórico de las propiedades y formas discursivas como tales ha recaído, sobre todo, en disciplinas como la Filología, la Literatura, la Retórica, la Diplomática, la Ecdótica, la Paleografía y la Lingüística. Se reflexiona acerca de la historicidad de las tradiciones textuales y su relación con la historicidad de otras tradiciones culturales, como la jurídica, desde la visión de la teoría de las tradiciones discursivas desarrollada por los discípulos del lingüista Eugenio Coseriu. Se destaca que los ritmos históricos de unas y otras tradiciones culturales pueden ser asincrónicos y que los moldes lingüísticos suelen ser mucho más conservadores que los de otras tradiciones culturales. Tomo como ejemplo las tradiciones textuales de las disposiciones legislativas en México (siglos XVI al XXI) y su relación con las tradiciones jurídicas que las han generado. Se discute cómo interpretar históricamente las tradiciones jurídicas y su relación con las textuales, según la hermenéutica y la historia conceptual y de los estratos del tiempo de Reinhart Koselleck.
