description Following Comparative History approaches, this paper examines the functional coincidences between two kinds of intermediary agents between a colonial power and the native authorities of areas under their control: the encomenderos in New Spain during the 16th century and the British residents of the English dominions in India during the 18th and 19th centuries. The paper posits that the concept of indirect rule is applicable to early life in New Spain and refutes those denying that the Spanish colonial experience lacked this characteristic. At the same time, the essay offers various remarks on the functional characteristics of the encomienda, many of which have been ignored by studies undertaken from a legal point of view or by the lack of attention paid to the bilateral nature of the relationship between encomenderos and encomendados.

Este artículo, alimentado por planteamientos de historia comparativa, examina las coincidencias funcionales entre dos tipos de agentes intermediarios entre un poder colonial y las autoridades nativas de los espacios bajo su control: los encomenderos de Nueva España en el siglo XVI y los British residents de los dominios ingleses en India en los siglos XVIII y XIX. El estudio argumenta que el concepto de indirect rule o dominación indirecta es aplicable a los periodos iniciales de Nueva España y desmiente a los que niegan que la experiencia colonial española haya carecido de esa característica. Paralelamente, a lo largo del estudio se hacen varias consideraciones al respecto de los rasgos funcionales de la encomienda, muchos de los cuales han sido inadvertidos por el lente jurídico con que se le ha estudiado o por la poca atención que se ha prestado al carácter bilateral de la relación entre encomenderos y encomendados.
