| description | This article analyses the tensions that drove African countries away from its initial enthusiasm for the International Criminal Court (ICC) and instead towards an alternative regional international criminal justice mechanism, established in 2014 with the signing of the Malabo Protocol. Although the legal tensions between the African Court and the ICC seem to have subsided, its seeds have not disappeared, and nor has the judicial and political infrastructure needed to eventually create the alternative mechanism proposed in the Protocol. The countries of the Global North that are the main supporters to the ICC would therefore do well to learn the lessons of the conflict, so as not to encourage the collective withdrawal of the African countries in the coming years from the Rome Statute. |

En este artículo se analizan las tensiones que alejaron a los países africanos de su inicial apuesta por la Corte Penal Internacional (CPI) y los encaminaron hacia un mecanismo regional alternativo de justicia internacional penal, establecido en 2014 mediante la aprobación del Protocolo de Malabo. Si bien la tirantez legal entre la Unión Africana y la CPI pareció haber bajado, su germen no ha desaparecido, como tampoco la infraestructura jurídica y política para, eventualmente, poner en marcha el mecanismo alternativo previsto en el Protocolo. Los países del Norte Global que apoyan a la CPI harían bien en aprender las lecciones del conflicto a fin de no propiciar en los próximos años la retirada colectiva de los países africanos del Estatuto de Roma.
